Mesothelioma is a form of cancer that is almost always caused by previous exposure to asbestos. In this disease, malignant cells develop in the mesothelium, a protective lining that covers most of the body's internal organs. Its most common site is the pleura (outer lining of the lungs and internal chest wall), but it may also occur in the peritoneum (the lining of the abdominal cavity), the pericardium (a sac that surrounds the heart) or tunica vaginalis.

Most people who develop mesothelioma have worked on jobs where they inhaled asbestos particles, or they have been exposed to asbestos dust and fibre in other ways, such as by washing the clothes of a family member who worked with asbestos. Unlike lung cancer, there is no association between mesothelioma and smoking. Compensation via asbestos funds or lawsuits is an important issue in mesothelioma (see asbestos and the law).

The symptoms of mesothelioma include shortness of breath due to pleural effusion (fluid between the lung and the chest wall) or chest wall pain, and general symptoms such as weight loss. The diagnosis may be suspected with chest X-ray and CT scan, and is confirmed with a biopsy (tissue sample) and microscopic examination. A thoracoscopy (inserting a tube with a camera into the chest) can be used to take biopsies. It allows the introduction of substances such as talc to obliterate the pleural space (called pleurodesis), which prevents more fluid from accumulating and pressing on the lung. Despite treatment with chemotherapy, radiation therapy or sometimes surgery, the disease carries a poor prognosis. Research about screening tests for the early detection of mesothelioma is ongoing.

Joy T asked: "What with the medical expenses, now lawyer expenses, is it worth the trouble?"
Question posted courtesy of:
jelmar106 replied: "I think the lawyer would take the case on a percentage, so that he only gets his percentage if you win the case. Do you know that mesothelioma is a lung cancer that is caused by inhaling asbestos? You'd want to talk to an attorney who specializes in medical cases. (Lawyers specialize just like doctors do.)"
reed replied: "The doctor is not kidding-your uncle will need all the help that he can get-and not just medical. The doctor, I'm assuming, would have track backed his history. If your uncle has been exposed to asbestos-a cancer-causing chemical-at his workplace-he can sue the company and get claims which will compensate for his treatment-which will surely be exorbitant as all cancer treatments are. Cold as this sounds-it would be practical and his right."
bkdaniels2006 replied: "Most people who develop mesothelioma have worked on jobs where they inhaled asbestos particles. Usually, they have worked around this long, thin fibrous crystalized material for years - 30 to 50 years. At the end, they get the disease. The cost of treatment is extreamly high. Treatment includes surgery, radiation, chemotherapy or all three. Although each indivisuals treatment needs vary, estimates range from $150,000 to over $ 1 million for treatment. This does not include an additional $4,100; for a course of the most popular anticancer drugs, AlimtaÒ and cisplatin. Multiple treatment cycles may be required, and a cure is not assured. In fact, even with aggressive treatment, the median survival of a patient after diagnosis with malignant mesothelioma is between one and two years. Eventhough, some mesothelioma treatment costs may be covered by health insurance, Medicare, or Medicaid much of the expense is left to the patient. A successfull victory, e.g. in a lawsuit could do much good to offset this cost and often makes the difference between life and death.Hope this answers your question!."

Dude D asked: "Who is this guy and is he suing everybody for everything? Look, you have the right to sue in civil court if you were done wrong. But how much is James Sokolove going to keep if you are awarded damages? 10% sounds ok. It will be much more than that I'm sure. Does anybody know? Do such lawyers really care if you receive damages or are they only out to make money?Really? Why doesn't he charge less?"
Question posted courtesy of:
grumpyoldman replied: "*LOL* Good one. Most lawyers charge at least 40% I think."
raichasays replied: "He probably charges on a sliding scale. Less of a percentage if it settles before trial, more if he has to go to court. It is all negotiable between the client and the lawyer, but he will not take only 10%. Why not charge less? Would you go to your boss and volunteer to take less to do your job? Everyone that works is trying to earn as much money as they can.If the lawyer did not care about injured persons, he could become a tax lawyer instead. They make a good living too.If you have mesothelioma and don't want to contact the offices of James Sokolove, or another lawyer, you can file the case yourself. Good luck with that"
drusillaslittleboot replied: "Why doesn't he charge less? Because lawyers charge a lot of money, and taking on class action and malpractice suits are risky - so you want a big chunk of the pie. Lawyers start charging at $200 an hour - and those are green associates and family lawyers, not the guys raking in the big bucks. My boyfriend's boss, who's a junior partner at a small firm in Toronto, charges $450 per billable hour, plus costs. My friend's father, who's a senior partner at one of the biggest firms in the country makes somewhere around 1.3 million dollars a year. Running a law firm isn't cheap, either. Searches through Westlaw and such cost money; the facilities you rent cost money; court filing fees cost money; so does that suit your lawyer wears, their desk, the paralegals and secretaries, etcetera, etcetera. And yes, lawyers care if you receive damages. Why? They want a reputation for being a good lawyer, and they don't want to get disbarred or sued for doing a crappy job. Strangely enough, we get fairly attached to our clients, too, especially the ones that were treated unfairly."
coragryph replied: "Sokolove is a class-action lawyer -- he files class action lawsuits on behalf of thousands or millions of people who have all been harmed in the same way. If a class has already been certified, then you may claim the benefits of that class action whether you want to participate or not -- but you can also choose to opt-out of the class and pursue your own individual claims if you want.Generally, class action lawyers get between 20% and 30% of the total recovery -- that being standard in the industry -- but they also bear all the costs, which can run into the millions of dollars for a large lawsuit, and they bear those costs whether the win or lose. Some lawyers care about the clients more than the money -- some are in it for the business and the profit -- as with any profession, the motivations vary."
